Employee QX, a resident of Landisburg, Perry County, suffered a work injury on January 18, 2008, while employed by GGNSC Camp Hill West Shore. The Claimant filed a Claim Petition alleging she sustained a work injury in the nature of a left-sided neck pain, pain radiating down her shoulder into her digits, pain in her anterior pectoral region on the left into her axilla, numbness and tingling; cervical pain radiating to bilateral upper extremities and mild carpal tunnel syndrome. The injury was as a result of pulling a patient over in bed when Claimant felt a pull in her shoulder and neck.

The Claimant, a resident of Harrisburg, Pennsylvania, suffered a work injury on February 19, 2008  while employed by Aramark, in the nature of lumbar injury occurring while he was lifting heavy trash bags when he felt sharp pain in his right leg and back.

After decision on claim petition, before Judge Eader in Harrisburg, injured worker received total disability benefits for eight years and then settled wage loss portion of claim against Zurich Insurance. Fifty-three year old Claimant ET, a resident of Harrisburg, Dauphin County, PA, suffered a work injury while employed as a hoist lift operator for Reynolds Construction Management. Claimant ET was hit on the head with a hard hat by another employee. Gallagher Bassett and Fidelity & Guarantee Insurance Company, the workers’ compensation insurance carrier, accepted the work injury as a neck strain. Claimant K.S. suffered a work injury while employed as a dock worker for Forward Air, Inc., when unloading a skid off the top of a truck. The work injury resulted in neck pain radiating down the left arm, headaches, a C4-5 disc protrusion and left foraminal stenosis, brachial neuritis or radiculopathy, cervical segmental dysfunction, left C6 radiculopathy, right C6 radiculopathy, and left C5 radiculopathy.

Our client had a previous non-work related back surgery after having left-sided symptoms. She was released by her surgeon to return to work. On her first day back; she was reaching to help a patient and felt a pop in her back followed by right-sided symptoms. We filed a Claim Petition alleging that her pre-existing problems had been aggravated by her work injury. The claimant’s treating physician testified against her, saying that the work injury was insignificant and that her problems resulted from her pre-existing, non-work related condition. He further testified that it was not unusual for a patient to have symptoms on one side and then on the other side of the body.
