How is Unemployment Compensation Offset and Credit Calcualted Against Workers’ Comp Benefits

In Pennsylvania (PA), Unemployment compensation reduces the amount of workers’ compensation benefits you receive by giving the workers’ compensation carrier an offset and credit due to the receipt of unemployment. But how is the offset calculated? Is the gross amount or the net amount (after taxes) used to calculate the credit? Section 123.6, Application of offset for Unemployment Compensation (UC) benefits, provides the simple answer: Workers’ compensation benefits otherwise payable shall be offset by the net amount an employee receives in UC benefits subsequent to the work-related injury. This offset applies only to UC benefits which an employee receives and which are attributable to the same time period in which an employee also receives workers’ compensation benefits.”
