Hello. My name is Tom Wilken. I’m a Pennsylvania workers’ compensation attorney with Calhoon and Kaminsky P.C. One of the most frequently asked questions we get would be, “what to do if my injury does not match what’s actually going on with my case.”

As you proceed through the system, you’ll find that the insurance company tries to make your description of injury very generic. They will try to lull you to sleep, so to speak, with a very generalized description of your injury, say, a sprain or strain as opposed to a herniated disk. If that’s the case, you need to obtain your bureau documents to see how your injury is described. If the injury as described is not as it is in real life, in other words, you had surgery for your neck or your low back, and that’s not included as part of the description, you need to have that description changed, and you need to file a petition to review to do that.
