What is a Temporary Notice of Compensation Payable?

Hello. My name is Tom Wilken, and I’m an attorney with Calhoon and Kaminsky P.C., here today to discuss with you what to do if you receive a piece of paper called a temporary notice of compensation payable.

That document entitles you to workers’ compensation monetary benefits for a period of 90 days, as well as payment of your medical bills for 90 days. Once the 90th day arrives, the insurance company can stop payment on both your workers’ compensation wage loss benefits and your medical benefits. They can also stop before 90 days. and quite frequently do. If they do not, they will be issued a document that says the temporary notice of compensation payable has been converted and your claim will be accepted.

If they stop it after 90 days or before 90 days, you must file a claim, petition to get your claim recognized. It is as though you never received any money from the workers’ compensation insurance company at all. You must file a claim petition to get your benefits at that point.
