My Employer Won’t Complete an Accident Report. Now What?

Nothing can be more frustrating than dealing with your employer and the insurance company following a Pennsylvania workplace accident. You may have taken all the right steps by notifying a union steward or representative and someone who possesses “supervisory authority.” You may have gone to great lengths to ensure that you told your employer about the work injury within 120 days from the incident. However, your employer might still refuse to create a report regarding the accident.

The accident report is one of the documents required by the Department of Labor and Industry. Your employer is supposed to complete it within 15 days from the date of your injury.

If your employer refuses to complete an accident report, there are some things you need to do:

  • Keep notes of the people you informed about the work accident.
  • Write down the date you reported the injury.
  • Notate in your records that your employer denied your request to have an accident report filed.
