How Do You Get Paid on Workers’ Compensation?

Hello. My name is Tom Wilken. I’m a Pennsylvania workers’ compensation attorney with Calhoon and Kaminsky P.C. We’re here today to discuss, “when is your check late?”

You’re entitled under Pennsylvania law to be paid as you were when you worked. In other words, if you were paid weekly, you’re entitled to be paid weekly under Pennsylvania workers’ compensation. The problem becomes when your check is a day or two late, whether or not the check is actually late, and the insurance company owes you additional money.

The easiest way to determine whether or not your check is late is to look at your last pay stub to see when you were paid through. The period will be clearly listed on your check. If your check is late, then the remedy is to file a penalty petition to get up to 50 percent penalties from the judge. Penalties are discretionary with the judge and can be handled very quickly once the petition is filed.
