Pennsylvania law allows an employer or insurer to reduce, modify, or terminate an injured employee’s workers’ compensation benefits. There are several circumstances under which Pennsylvania law allows employers and insurers to make changes to benefits. The following are instances in which benefits may change:

  • Change in employment status: If an injured worker becomes employed, either at their previous place of employment or with a new employer, wage-loss benefits may be subject to change. The change in wage-loss benefits will depend on whether the employee earns a lesser or equal amount to what they earned prior to the injury.

 

  • Change in disability status: An insurer or employer has the right to challenge the disability status of a worker who has been receiving total disability compensation for a certain number of weeks. If a medical evaluation results in the determination that the employee is less than 50 percent disabled, then the employee’s status becomes changed to a partial disability and the number of weeks the employee may receive benefits is subject to a limitation.
