If your claim for Pennsylvania workers’ compensation benefits has been denied, you may be unsure of your options. It is not unusual for an employer or an insurer to deny a petition for benefits. The reason for the denial may be that the employer or the insurer believes the that you failed to show that the injuries incurred were work-related, that the injury is causing any earning loss or that you failed to properly notify your employer of the injury.

Whatever the reason for the denial, it may still be very possible to have your claim approved. The Pennsylvania Bureau of Workers’ Compensation allows workers to file a Claim Petition when an insurer or an employer denies a claim. A workers’ compensation judge will determine whether the applicable legal standards justifies an award.

The appeal process, however, is lengthy and complex, and you will probably require representation by an experienced Pennsylvania workers’ compensation lawyer.
