Hello. My name is A.J. Palutis. I’m a Pennsylvania workman’s compensation attorney, and the question often arises, “can a workman’s compensation carrier perform surveillance on my daily activities?”

The answer to that question is yes. Yes, if you are in a public place. Being in a public place, an individual does not have an inherent right to privacy. However, a surveillance team may not at any time trespass upon your property in order to take pictures or film of any activities that you’re performing. They may, however, use a public thoroughfare, like a sidewalk or a road adjacent to your property, in order to film your activity.

It is also important to remember that at no time may a surveillance company audio.
