On July 22, 2011, Marcellus Shale worker Kerry Duncan was killed while working on a natural gas well in Greene County, PA. Mr. Duncan was employed by Target Drilling of Smithton, PA, and was tearing down rigging. OSHA is investigating the incident.

How Do I Get My Pennsylvania Workers’ Compensation Settlement Approved As Quick As Possible?

There is a very little known method and hardly ever used procedure for getting the workers’ comp settlement money as quickly as possible by getting approval in 19 days. § 131.60. provides for a fast resolution hearing. The request for the resolution hearing to obtain approval of the settlement (compromise and release) may be requested at any time after all parties are prepared to proceed.

If a petition is pending before a judge, the request for a settlement or resolution hearing must be directed to the assigned judge. If a petition is not pending before a judge, the request for a resolution hearing must be directed to the Judge Manager for the judge’s office serving the county of the claimant’s residence.

The assigned judge’s office will schedule the resolution hearing within 14 business days of receiving the request for a resolution hearing. The Judge Manager may reassign any case from one judge to another to ensure compliance with the resolution hearing requirements of sections 401 and 401.1 of the Act.

The judge conducting the resolution hearing will require proof that a petition has been filed with the Bureau under § 131.11 (relating to filing, service and proof of service), and will make the proof a part of the record. Upon receiving the proof, the judge shall proceed with the hearing and circulate a final decision within 5 business days of the hearing.

So, within 19 days, you have your Pennsylvania workers’ compensation settlement approved by a Judge’s written, legally binding and enforceable, decision ordering the workers’ compensation carrier, employer or self-insured to pay the settlement.
